TERMS AND CONDITIONS OF AUCTION SALES
NOTICE: All Bidders and others attending an auction agree that they have read and fully understand these terms and agree to be bound thereby. Announcements made at the auction take precedence over these terms and conditions.
All purchasers are required to have a bidder’s number.A photo ID is required to register.
Purchasers may inspect the merchandise and are urged to do so. All items are sold “AS IS” and in its present condition. Caveat Emptor – “let the buyer beware”
Payment is due at the completion of the auction. We accept Cash, Personal Checks, Master Card, Visa,Discover, Traveler Checks, Certified Check, and out of State Checks – which have to be approved ahead of time.
4.Time Frame for Removal of Goods:
All goods must be removed from the premises the day of the sale unless special arrangements are made with one of the auctioneers.
5.Removal of Purchased Merchandise:
Buyers must remove the merchandise from the premises at their own risk, expense and liability. Purchases can be removed only upon presentation of original paid bill. Bullock’s Bid ‘N Buy and Cresswell Auction Service are not responsible for items that are not removed within the time specified and has the option of dumping, storing or re-selling any item purchased at the expense and risk of the Buyer.
6.Condition of Items Sold:
Bullock’s Bid ‘N Buy and Cresswell Auction Service are not responsible for the correct description, authenticity, or defect in any lot and makes no warranty in connection thereof. No deduction will be allowed on damaged articles as all goods are exposed for public exhibition and are sold "AS IS" and without recourse. It is for this reason that all Buyers should take the time to inspect any items prior to the sale.
7.Distribution of Items Sold:
All items will be sold on a unit basis, unless listed and announced as being sold by the "Lot". The auctioneers reserve the right to group one or more lots into one or more selling lots or to subdivide into two or more selling lots. Our auctioneers also reserve the right to withdraw from sale any of the items listed. We also reserve the right to add items to the sale that are not listed for the auction. Whenever the best interest of the Seller will be served, the auctioneers reserve the right to sell all of the items listed in bulk.
No claims or allowance of any sort will be allowed once the goods have been removed from the premises.
9.Dispute Between Bidders:
If any dispute arises between two or more Bidders, both thinking that they had the highest bid; the auctioneer will open the bid up between the two bidders only. The auctioneer has this right to settle the dispute.
10.Personal and Property Risk:
Persons attending during exhibition,sale or removal of goods assume all risks of damage of or loss to person and property, and specifically indemnify and hold harmless Bullock’s Bid ‘N Buy and Cresswell Auction Service and the Seller from any and all damages, claims or liabilities from injuries to persons or property of any type whatsoever.
Purchaser agrees to indemnify and hold harmless Bullock’s Bid ‘N Buy and Cresswell Auction Service and the Seller from and against all claims and liabilities relating to the condition or use of the items purchased.
The record of sale kept by the auctioneer and clerk will be taken as final in the event of any dispute.
The auctioneer is acting as agent for the seller and is not responsible for acts of its principals.
Purchaser shall pay applicable sales or use taxes imposed by taxing authorities unless Purchaser presents a resale certificate exempting the Purchaser, Bullock’s Bid ‘N Buy and Cresswell Auction Service from the payment of any such sales and use taxes. There is no sales tax at an estate auction. Sales tax will only be added at a consignment auction.
The auctioneer may add other terms and conditions of the sale by announcements on the day of the auction.Auction day announcements take precedence over any prior written terms and conditions.
